Visa Cancellation After Resignation in the UAE: What Happens to Your Status

Arabic-language reference guide to what happens to your work permit and residency when you resign or are terminated in the UAE, under Federal Decree-Law No. 33 of 2021. The full article is in Arabic. General legal information, not legal advice — verify with MOHRE/ICP or a lawyer.

When employment ends in the UAE, the employer must cancel the work permit, and a grace period applies before you must leave or transfer status. Under the current law, an employee can generally move to a new employer, and the old automatic labour ban has largely been removed. An employer may not lawfully withhold your passport. A false absconding report can be contested. Exact grace-period durations and procedures change — verify the current ICP/MOHRE rules before acting.

    Frequently asked questions

Can my employer cancel my visa immediately when I resign?

The employer is obliged to process the cancellation after the employment relationship ends and dues are settled — not as a punishment. A legal grace period is usually granted to remain in the country after cancellation to arrange your status; its length varies by the current ICP rules.

Is there still a six-month labour ban in the UAE?

Federal Decree-Law No. 33 of 2021 removed much of the old automatic ban, and moving to a new employer is possible in most cases, subject to your contractual notice period. Some special cases remain, so confirm your individual situation before resigning.

Can my employer keep my passport until cancellation?

No. Withholding an employee's passport without consent is unlawful in the UAE. The passport is your personal document, and you can file a complaint with the competent authorities if it is withheld.
